Tatyana Voloshchuk is a partner in the firm's Business Law and Intellectual Property (IP) practices.

With more than 16 years of experience, Tatyana assists clients with procuring, protecting and enforcing their intellectual property rights. She works with a wide variety of clients, from solo inventors and start-ups to large multinational corporations.

Her practice focuses on all aspects of intellectual property law, and she has extensive experience in patent, trademark and copyright prosecution and litigation. Tatyana also advises clients with regard to due diligence matters including intellectual property clearance, licensing and acquisition. Her practice includes preparing and prosecuting U.S. and foreign patents in a variety of technical fields, including pharmaceuticals, laundry and home care, hair care, medical devices and instruments, packaging, green technology and consumer products. She also has extensive experience preparing and prosecuting U.S. and foreign design patents.

Tatyana has represented clients in numerous patent, trademark and copyright matters through every stage of litigation, from pre-filing investigation through trial and appeal. She has been a member of litigation teams in state and district courts throughout the country, as well as the International Trade Commission. Tatyana is also regularly involved in trademark opposition and cancelation proceedings before the Trademark Trial and Appeal Board (TTAB). 

Outside of her legal work, Tatyana is an accomplished fiber artist. Her works are displayed in corporate and private collections throughout the world.

  • Drafted and prosecuted a worldwide patent portfolio for a medical device company, including medical intervention, imaging and measurement technologies. 
  • Performed competitive landscape and freedom-to-operate analyses for a major international drug delivery device company, including freedom-to-operate clearances for infusion pump, autoinjector and nasal delivery technologies.
  • Responsible for worldwide patent portfolio drafting and filing strategy for a generic pharmaceutical company specializing in pharmaceutical products to treat patients with chronic and life-threatening diseases. The company owns 29 active Drug Master Files and has 15 approved ANDA commercial products.
  • Drafted and prosecuted U.S. patent portfolio for a multinational corporation relating to hair care and laundry products.
  • Responsible for U.S. design patent and trademark portfolios for a major tire manufacturer in Asia.
  • Successfully argued multiple ex parte appeals to the PTAB, resulting in full withdrawal of patentability rejections and allowance of all patent claims
  • Represented generic pharmaceutical companies in multiple Hatch-Waxman ANDA cases involving generic versions of drugs, such as Abilify®, Allegra®, Doryx®, Coreg CR®, Vigamox® and Moxeza®.
  • Successfully represented a paint manufacturing company in a breach of contract and trade secret infringement litigation against a major national company, resulting in a verdict in favor of the client.
  • Served as lead counsel in multiple copyright infringement litigations, defending clients against claims by photographers and negotiating successful settlements.
  • Served as lead counsel in TTAB opposition proceeding, including full trial, successfully defending a software client and clearing the client’s rights to use its service mark.
  • Achieved multiple successes on behalf of clients through litigation and pre-litigation/cease and desist letters, including early and practical resolution of disputes.
