This month, attorneys Tom Vangel, Jamie Radke and Lindsey McComber collaborated on an article for Massachusetts Auto Dealer, outlining how Massachusetts' new Advanced Clean Truck (ACT) and Heavy-Duty Omnibus (HDO) rules may impact automobile dealerships.
The new regulations are set to take effect on January 1, 2025, and they require that manufacturers sell an increasing number of zero emission medium- and heavy-duty vehicles greater than 8,500 pounds GVWR, from 2024 to 2035. The implementation of this mandate as scheduled will have a major impact on Massachusetts automobile dealers as well as unintended consequences for the transportation sector.
Dealers argue that the current infrastructure, particularly the number of charging stations, is insufficient to support these changes. Because of this, the Massachusetts State Automobile Dealers Association (MSADA) and the Trucking Association of Massachusetts (TAM) are advocating for a delay in the enforcement of the ACT and HDO rules until 2027. A letter from 38 state representatives echoed their concerns, urging the state to postpone the regulations to allow for better preparation and infrastructure development.
